These Terms and Conditions ("Terms") govern the supply of services by TalentLeaf (ABN 74 701 161 122) ("TalentLeaf", "we", "us", "our") to you ("you", "the client"). By requesting a quote, placing an order, or engaging our services, you agree to these Terms. Please read them carefully. If you do not agree, do not engage our services.
1. Nature of our services
TalentLeaf provides copywriting and document-preparation services (writing services) only. These are not legal services and are not immigration assistance or immigration advice. We are not a registered migration agent and not an Australian legal practitioner, and nothing we provide should be relied on as legal or migration advice.
Our services are not covered by legal professional privilege, by any professional indemnity insurance applicable to Australian legal practices (in Victoria, arrangements such as the Legal Practitioners' Liability Committee), or by the Law Institute of Victoria Professional Standards Scheme. You are responsible for obtaining your own advice from a registered migration agent or Australian legal practitioner about your matter.
2. Quotes and engagement
A quote is an invitation to proceed and is not binding until we confirm your order in writing. We may decline any request at our discretion. The scope of work is limited to what is described in our written confirmation.
3. Fees and payment
Fees are as set out in your quote or order confirmation and, where stated, are inclusive of GST. Unless agreed otherwise, work commences once payment (or an agreed deposit) has been received. Prices displayed on this website are indicative and may change without notice.
4. Your responsibilities
You are responsible for providing accurate, complete and lawful information and materials. We rely on the information you provide and do not independently verify it. You warrant that you are entitled to provide that information to us and that our use of it will not breach any law or third-party right. We are not responsible for outcomes arising from inaccurate, incomplete or misleading information supplied by you.
5. Deliverables and revisions
We will prepare the agreed document with reasonable care and skill. Unless stated otherwise, an order includes one round of reasonable revisions to the delivered document. Additional revisions or changes to scope may be quoted separately.
6. Turnaround
Any turnaround time is an estimate only and depends on the timely provision of information by you. We are not liable for delays caused by incomplete information, third-party platforms, or circumstances beyond our reasonable control.
7. No guarantee of outcome
We do not guarantee, and make no representation about, the outcome of any visa application, nomination, sponsorship or other decision made by the Department of Home Affairs or any other body. Decisions are made by those bodies applying their own criteria, which may change.
8. Refunds
Because our services are bespoke and prepared specifically for you, fees for work already commenced or completed are generally non-refundable, except where required by the Australian Consumer Law. Nothing in these Terms excludes rights that cannot lawfully be excluded.
9. Intellectual property
On full payment, you receive a licence to use the delivered document for your intended purpose. We retain ownership of our underlying templates, methods and know-how.
10. Confidentiality
We treat information you provide as confidential and use it only to perform the services, except where disclosure is required by law. Please see any privacy information we provide for how we handle personal information.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with the services is limited to the fees paid by you for the relevant order. We are not liable for indirect or consequential loss. Certain rights and guarantees under the Australian Consumer Law cannot be excluded, and nothing in these Terms limits those rights.
12. Third-party platforms
Where our services involve third-party platforms (for example, job advertising platforms), we are not responsible for their availability, policies, fees or conduct.
13. Governing law
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
14. Changes to these Terms
We may update these Terms from time to time. The version in force at the time you place an order applies to that order.
